The levy enables the government to either seize and sell your possessions held by you or someone else, garnish your wages and/or empty your bank account to satisfy your back taxes. The government will levy when the following occurs:

  • The IRS has assessed the tax and sent you a Notice and Demand for Payment
  • You neglected or refused to pay the assessed tax
  • The IRS send a final notice of intent to levy and notice of your right to a hearing at least 30 days prior to the levy.

You can challenge a levy notice through a Collection Due Process Hearing provided the request is made within 30 days of the Notice. A bankruptcy filing stops all levies while providing time to assess your options.
